Terms of Use

These Terms of Use ("Terms") govern your access to and use of the GoldMind app ("GoldMind," the "App," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use GoldMind. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@goldmind-solutions.com of any unauthorized use.

3. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use GoldMind for your own non-commercial mental performance training.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse engineer, decompile, or attempt to extract source code
  • Interfere with or disrupt the App or its servers
  • Use the App to harass, harm, or impersonate others
  • Scrape, copy, or redistribute App content without permission
  • Submit content that infringes the rights of others or violates law

5. User Content

Journal entries, check-ins, reflections, game-day notes, and other content you create in the App ("User Content") belong to you. By using the App, you grant GoldMind a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely as necessary to operate and improve the App and provide it to you.

6. Subscriptions and Billing

GoldMind may offer paid subscriptions. Subscriptions are billed and managed by Apple (App Store), Google (Play Store), Stripe, or another payment processor. Subscriptions typically auto-renew unless cancelled before the renewal date. Refunds and cancellations are handled by the applicable processor under their terms. We do not store full credit or debit card numbers or CVV/security codes.

7. Medical and Mental Health Disclaimer

GoldMind is a mental performance training app and is not medical care, therapy, diagnosis, or treatment. See our Medical & Mental Health Disclaimer for full details. If you are in crisis, call or text 988 (US) or your local emergency number immediately.

8. Intellectual Property

The App, including all content, lessons, designs, logos, and software, is owned by GoldMind or its licensors and is protected by intellectual property laws. Except for User Content, all rights are reserved.

9. Third-Party Services

The App may rely on third-party services (for example, hosting, AI, analytics, payments). We are not responsible for the practices or content of those services.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOLDMIND AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

12. Indemnification

You agree to indemnify and hold harmless GoldMind from any claims, damages, or expenses arising out of your use of the App or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. You may delete your account at any time by contacting us.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Texas, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version. Continued use of the App after changes means you accept the updated Terms.
